In yoxu* issue o f Friday, May 13, 1027, in an editoral with reference to the charges filed with the County Board o f Education, against Harry Aultman, a* County Superintendent, you stated that the County Board o f Education was without jurisdiction in the case, and that it was necessary fo r the Court to determine the inno- cense or guilt, before it was the duty o f the Board to take any action. The Citizens' Committee, which in stituted the charges against Mr.1/Ault man, have requested me to advise yon that this is a misstatement o f the law, in reference to this matter. Section 7701, General Code o f Ohio, provides as follows; “JJach hoard may dismiss any ap- *pointee; or teacher fo r inefficiency, neglect o f duty, immorality, or im proper conduct, No.teacher shall be dismissed by any board unless, the charges are first reduced to writing and an opportunity he given fo r de fense before the board, or a com- , jmittee thereof, and a majority of (he full membejship o f the board, vote, upon roll call in favor o f such dismissal.” It can ibe plainly seen by.reading the above Section, that the County Board o f Education does have juris diction to hear the'charges, and it is not necessary for any court to pass upon the guilt or innocence of a per son charged with' improper conduct before a school board. • In fact the' Court would have no jurisdiction to .hear tfie mhtter at all, i f being a matter, to^he heard and de termined solely by the county board. He is in jail pend ing the giving o f bond to guarantee support* o f his three-months child, providing the sentence is suspended- Stevens has confessed to .Sheriff Tate that he was a deserter from the navy and asked that the department be no tified. . ; PRESIDENT SAYS HIS * HANDS WERE TIED President.
