He had been a p a t i e n t since Wednesday and for the last year resided at Wright's Rest Home in Mason. Mr. Colvin retired from the C h a s e Colvin Wire Fence Co. of South Charleston in 1943 and left that village in 1953. He was born March 1, 1864 in Greene County. He was a member of the South C h a r l e s t o n M e t h o d i s t Church. Surviving are three daugh­ ters, Mrs. J a n e M a r c h of Cincinnati, Mrs. Edith Dal­ ton of C o l umb u s and Mrs. AnnWa r n e r o f C h a r g r i n Falls: a brother. Dr.D.Leigh C o l v i n of New York City, who once ran for president of the United States on the Prohibition ticket; six grand­ children and a great-grand­ child. A number of inquiries have been received as to whether payments ma d e to farmers under the a c r e a g e reserve program will be subject to the self-employment tax and thus count toward the income used in computing social se­ curity benefits. The social security admin­ istration and the internal re­ venue service have taken the position that soil bank pay­ ments if made to the opera­ tor of a farm are in the na­ ture of r e c e i p ts from farm operations in that they re­ place a c e r t a i n extent in­ come which the farm opera­ tor could have expected to receive from the normal use of the land. Such payments, thus, are comparable to earnings from the o p e r a t i o n of the farm and therefore, soil bank pay­ ments will generally be in­ cluded in computing the a- mount to bb reported as earn­ ings from self-employment by a f a rm operator. Under the social security act, own­ er operators, farm partners, joint v en t u r es, share ten- nants, and sharecroppers are considered to be farm oper­ ators. They are still studying the problems presented by the payment of s o i l bank pay­ ments to landlords. The 1956 amendments to the s o c i a l s e c u r i t y act provide that, farm i n c o m e of a landlord is includable for social se­ curity purposes if the land­ lord, in accordance with the rental arrangement, mater­ ially participates in produc­ tion of the agricultural com ­ modities on his farm. Fifty men turned out for the fox drive held by the New J a s p e r firemen S a t u r d a y morning. No fox were bag­ ged. A trap shoot was held in the afternoon.
